Terms of Use
These terms are an agreement between you and [LEGAL NAME OF THE OPERATOR], [POSTAL ADDRESS] ("we"), the operator of Nearly. Apple's Standard End User License Agreement also applies to your use of the app. Our Privacy Policy explains how we handle your data.
1. What Nearly is
Nearly lets two partners share the distance between them, their local time, moods, notes, photos, a countdown to their next meeting and answers to a daily question, in the app and on widgets. It also counts a shared streak.
2. Who can use it
- You must be at least 18.
- Use Nearly only with a partner who knowingly agrees to pair with you. Each partner controls their own location sharing.
3. Acceptable use
We have zero tolerance for objectionable content and abusive users. You agree not to:
- use Nearly to monitor, track or control anyone without their knowledge and consent, or to stalk, harass or intimidate anyone;
- install or pair Nearly on someone else's phone;
- send unlawful, threatening or abusive content;
- send photos you don't have the right to share, photos of people without their consent, or any sexual content involving a minor. We report child sexual abuse material to the authorities where the law requires it;
- interfere with the service or try to access other people's data.
We act on reports within 24 hours. Content that breaks these rules is removed and the person who posted it is banned. You can block your partner in Account & Privacy: this ends the connection right away, deletes your shared content, notifies us, and stops you pairing with each other again. If you feel unsafe, unpair at any time in Account & Privacy. This stops sharing for both of you immediately.
4. Nearly Pro and payments
- Nearly is free to use. Nearly Pro is available as a monthly or yearly subscription, or as a one-time lifetime purchase, at the prices shown in the app before you buy.
- Payment is charged to your Apple ID. Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. Cancel anytime in Settings › Apple ID › Subscriptions.
- If a free trial is offered, its length and the price charged when it ends are shown before you start. If you don't cancel before the trial ends, the subscription begins and you are charged.
- One purchase unlocks Pro for both partners while you are paired. If you unpair, Pro stays with the person who paid.
- Memories: with Pro, photos are kept until the sender deletes them. If Pro ends, photos stay for 30 more days; after that, photos older than 24 hours are deleted. Memories isn't a backup service, so keep your own copy of anything you can't lose.
- Refunds are handled by Apple under its policies: request a refund. Your statutory rights as a consumer are not affected.
5. Your content
You keep ownership of the notes, answers and photos you send. You give us permission to store and deliver them to your partner, only to run the service.
- On the free plan, photos are deleted after 24 hours. With Pro, they're kept as described in section 4.
- Only the sender can delete a photo. Your partner can screenshot what you send, and photos can appear on their widgets, so only send what you're comfortable sharing.
- To report a note or photo, tap its flag. To report a bug, use ••• › Report a Bug. You can also email hello@nearly.love.
6. Streaks
Streaks and cloudy days are a fun feature with no monetary value. We may change how they work, and a streak can be lost, including through technical problems. Unpairing ends the streak.
7. Ending
You can delete your account at any time in the app. Deleting your account or unpairing deletes the couple's photos for both partners, including Memories. Deleting your account doesn't cancel an Apple subscription; cancel it in Settings first.
8. No safety guarantee
Distances and times are approximate and depend on your devices, connection and settings. Don't rely on Nearly for emergencies or personal safety. In an emergency, contact local emergency services.
9. Liability
Nearly is provided "as is". To the extent the law allows, we are not liable for indirect or consequential losses. Nothing in these terms limits liability that can't be limited by law, or the mandatory consumer rights of the country where you live.
10. Changes and law
We may update these terms and will tell you in the app before meaningful changes apply. These terms are governed by the laws of [GOVERNING LAW], without depriving you of the protection of the mandatory laws of your country of residence.
