Privacy Policy
The short version
- Your location is shared only with your partner, only while you both turn sharing on.
- We keep only your latest position, never a location history.
- Photos are shared only with your partner. On the free plan they're deleted after 24 hours. With Pro they're kept until the sender deletes them.
- We don't sell your data, show ads, or share it with data brokers.
- You can pause sharing, unpair, or delete your account and data inside the app at any time.
1. Who we are
Nearly is operated by [LEGAL NAME OF THE OPERATOR], [POSTAL ADDRESS] ("we", "us"). We are the controller of your personal data. Contact: privacy@nearly.love.
EU representative (Art. 27 GDPR): [NAME AND ADDRESS OF EU REPRESENTATIVE].
2. What we collect and why
| Data | Why | Legal basis (GDPR) |
|---|---|---|
| First name, language, time zone | Show you to your partner; show your local time and sky | Contract (Art. 6(1)(b)) |
| Sign in with Apple identifier | Create your account and let you back in on a new phone. We don't ask Apple for your email | Contract |
| Your latest location (only while sharing is on) | Calculate the distance between you and your partner | Consent (Art. 6(1)(a)); you can withdraw it anytime by pausing sharing |
| Mood, notes and daily-question answers | Deliver them to your partner and their widget | Contract |
| Photos you send, when you sent them, and whether your partner has seen them | Deliver them to your partner, show them in the app and on widgets, and keep Memories for Pro couples | Contract |
| The next date you'll be together and the place, if you add them | Show the same countdown to both of you | Contract |
| The days each of you was active, and your streak count | Count your streak and send the evening reminder | Contract |
| Push notification token, your notification choices, and a log of which types we sent and when | Notify you of notes, photos, moods and pairing changes; respect your choices and sending limits. The log holds no content and is kept for 60 days. Notes and moods aren't placed in the notification we send through Apple: your phone fetches them from us when one arrives | Contract; you can turn notifications off in the app or in iOS Settings |
| Subscription status | Unlock Nearly Pro for you and your partner | Contract |
| Reports you send us: your message, your account ID, your app version, device type and iOS version, and the note's or photo's ID if you report one | Fix bugs and review reported content | Legitimate interest (Art. 6(1)(f)) |
| A few usage events (for example "note sent", "paywall shown", whether notifications are on, whether a notification was opened) and how you found us | Understand what works and fix problems | Legitimate interest (Art. 6(1)(f)); you can opt out in Account & Privacy |
Usage events never include your location, notes, moods, answers or photos. We don't use your data for advertising and we don't track you across other apps or websites.
The cities you type during setup are looked up through Apple's map services to show a first distance preview. We don't store them on our servers.
3. Location in detail
- Location sharing is off until you turn it on and accept the explanation screen. iOS also asks for your permission.
- Your partner sees the distance between you only while you both share. On the free plan the distance is rounded.
- We store only your most recent position. Each new position replaces the previous one.
- If you choose Always in iOS, your position is sent when you move about 500 m, even with Nearly closed, so the distance stays current. With While Using, it's sent only when Nearly is open. You can change this in iOS Settings.
- Pausing sharing hides your position from your partner immediately. Unpairing or deleting your account deletes it.
4. Photos in detail
- Nearly uses your camera or photo library only when you choose to send a photo. You pick each photo; we don't read the rest of your library.
- Photos are resized before they're sent, and stored so that only you and your partner can fetch them through the app.
- Photos are encrypted in transit and at rest, but they are not end-to-end encrypted.
- Your phone checks each photo for nudity using a model inside the app, plus Apple's check if Sensitive Content Warning or Communication Safety is on. Neither the photos nor the results are sent to us or to anyone else, and they aren't used for training or analytics. Photos that look sensitive show a warning before sending, arrive blurred until tapped, and stay off widgets. The check can make mistakes.
- If a photo or note is reported, we may look at that reported item to review it.
- A photo appears on your partner's widgets if they use them, so people near their phone may see it. Your partner can also screenshot what you send, so we can't guarantee a photo is gone from their device.
- Only the person who sent a photo can delete it. Deleting removes it for both of you.
5. Who processes your data
We use these service providers, under data processing agreements, only to run Nearly:
- Cloudflare, Inc.: hosting, database, photo storage and real-time connections.
- Apple Inc.: push notifications, in-app purchases (Apple handles payment; we never see your card) and city search during setup.
- RevenueCat, Inc.: subscription status (your Nearly account ID and purchase records).
- PostHog (EU region): usage events, if you haven't opted out.
Some providers may process data outside your country, including in the United States. Where required, transfers rely on the European Commission's Standard Contractual Clauses or an adequacy decision.
Your partner sees what Nearly is designed to share with them: your name, time zone, mood, notes, photos, answers you both reveal, whether you've been active today, your shared countdown, and the distance while you both share.
6. How long we keep it
- Location: only the latest position, deleted when you unpair or delete your account.
- Notes, moods, answers, countdown, streak: until you unpair or delete your account.
- Photos, free plan: hidden after 24 hours and deleted from our servers shortly after. Copies in the app are removed the next time it syncs.
- Photos, Nearly Pro ("Memories"): kept until the sender deletes them, you unpair, or either of you deletes your account.
- Photos when Pro ends: kept for 30 more days. After that, photos older than 24 hours are deleted.
- Unpairing or deleting your account: deletes all of the couple's photos for both partners.
- Reports: until you delete your account.
- Account: until you delete it.
- Backups: deleted data may stay in encrypted backups for up to 30 days before it is overwritten.
- Purchase records: kept as long as the law requires for accounting.
7. Your rights
You can access, correct, export or delete your data, object to processing based on legitimate interest, and withdraw consent at any time. Delete everything in the app: ••• › Account & Privacy › Delete Account. For anything else, email privacy@nearly.love; we reply within one month.
You can also complain to your data protection authority, for example the CNIL (France), the Garante (Italy), or the AEPD (Spain).
8. Age
Nearly is for adults. You must be at least 18 to use it. We don't knowingly collect data from children.
9. Security
Data is encrypted in transit (HTTPS) and at rest by our hosting provider. Access is limited to what is needed to run the service.
10. Changes
If we change this policy in a meaningful way, we'll tell you in the app before the change applies.
